Noise Ordinance Enforcement Plan
In compliance with the Settlement Agreement with the Cities
of Del Mar, Solana Beach and the River Park JPA, the 22nd District
Agricultural Association (22nd DAA) and the Del Mar Thoroughbred
Club (DMTC) will execute the following Noise Enforcement plan.
NOISE ENFORCEMENT PLAN
Under the direction and supervision of the 22nd DAA and the DMTC Event Manager, noise monitoring equipment will be placed on
the perimeter of the Fairgrounds property, except during the annual San Diego
County Fair. This equipment will be set to monitor decibel levels of
Fairgrounds events other than the San Diego County Fair. If decibel levels
exceed the Noise Ordinance levels a noise file will be emailed to a smartphone
that will be monitored by the Event Manager. The Noise Ordinance will be on the
Del Mar Fairgrounds website, along with the noise compliant phone number:
858-794-1104. The District shall forward monitoring results documenting levels
above the ordinance limits to both the City Manager of Solana Beach and Del Mar
for Discussion with District staff.
Onsite Event Managers will work with Fairgrounds clients to
make sure all events comply with the Noise Ordinance. The noise monitoring
equipment will be monitored daily and the Event Managers will be proactive and
review any notices from the software. If the noise monitoring equipment sends a
noise file to the smart phone, staff will investigate the noise issue and take
appropriate action to mitigate noise. The goal of the 22nd DAA is to
mitigate noise issues prior to their impacting the surrounding community.
Between the hours of 7:00AM
to 10:00PM, ambient noise level may not exceed 60 dBA measured in the
residential neighborhoods surrounding the Association. Exterior ambient noise is not
permitted between 10:00PM and 7:00AM. All sound producing devices used by
Licensee must be of such a nature and operated so as not to cause annoyance or
inconvenience to patrons or any other Licensee. The Association reserves the right
to terminate Licensee's use of any sound-producing device, which it determines, in
its sole discretion, violates this provision. A $1000 fee will be billed to the Licensee
for violation of the noise ordinance. The noise limits above may be adjusted as follows
to account for the effects of time and duration on the impact of noise levels:
1. Noise that is produced for no
more than a cumulative period of 30 minutes in any hour may exceed the noise limit
by 3 dBA.
2. Noise that is produced for no
more than a cumulative period of 15 minutes in any hour may exceed the noise limit
by 6 dBA.
3. Noise that is produced for no
more than a cumulative period of 10 minutes in any hour may exceed the noise limit
by 8 dBA.
4. Noise that is produced for no
more than a cumulative period of 5 minutes in any hour may exceed the noise limit
by 11 dBA.
5. Noise that is produced for no
more than a cumulative period of 2 minutes in any hour may exceed the noise limit by 15 dBA
